KAFANTAYENI PROJECT: RIGHT TO SENTENCE RE-HEARING IN HIGH COURT WHERE SUPREME COURT ALREADY DISMISSED APPEAL ON SENTENCE

For those it may interest.

The issue whether, after the Kafantayeni case and in light of the McLemonce case, a convict who already lodged an appeal in the Supreme Court against the unconstitutional mandatorily imposed Death Penalty and had his/her appeal against the sentence dismissed is still entitled to a Sentence Re-hearing in the High Court arose for the first time in this case - Jackson Chinkango case - since the Sentencing Re-hearings commenced at Zomba High Court. And Justice Potani deals with that issue in the attached case.
