The answer is "b" because..... It is stated that India is not a member of ICC and hence it does not have the obligation to cooperate with ICC so ICC can neither send its enforcers to arrest Dusht Buddhi nor can it ask India to extradite him...... But if Dusht Buddhi travels to a member state of ICC then that member state will have an obligation to arrest him........

In my opinion , the answer should be "C" because it has been clearly stated that ICC has jurisdiction of everyone. So the question of member states co operating doesn't arise.

Principle: Only states may be parties to the International Criminal Court.

Explanation: ICC has jurisdiction over everyone. But only member countries have an obligation to cooperate with ICC.

Facts: India is not a member of ICC. Dusht Buddhi is a notorious politician in India who has presided over the genocide of a lot of people.The ICC has charged him of such a heinous crime. what can ICC do?

a) ICC can get India to arrest and extradite him.

b) ICC should wait for him to travel to a country which is a member and then get that country to arrest him.

c) ICC should send its enforcers to arrest him.

d) None of the above.

The given answer is (b)... but why???
